1.Acceptance of terms
These Terms & Conditions (“Terms”) form a binding agreement between you and WITHINFEED, operated by Second Nature. By accessing or using the platform, creating an account, or participating in any opportunity, you agree to these Terms and our other policies, including the Privacy Policy, Usage & Content Rights, Payment & Access Pass Terms, and Community Guidelines.

2.Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use WITHINFEED. If you use the platform on behalf of a business or brand, you represent that you are authorized to bind that entity to these Terms.
3.Account creation and responsibilities
- Provide accurate, current, and complete information and keep it updated.
- Maintain the confidentiality of your credentials and all activity under your account.
- Notify us promptly of any unauthorized use or security breach.
- You are responsible for the conduct of all users on your account, including additional brand seats.
4.User types and platform role
Roles
- Creators — individuals whose primary value is audience, personality, storytelling, and content creation.
- Creatives — production talent such as photographers, videographers, editors, designers, and producers.
- Brands — businesses creating opportunities, briefs, and campaigns.
- Admins — the WITHINFEED / Second Nature team operating and moderating the platform.
Platform as facilitator
WITHINFEED provides discovery, matching, coordination, and payment-facilitation tools. We are not a party to the underlying engagement between a brand and a creator or creative, are not an employer or agency of any user, and do not guarantee campaign results, sales, reach, or performance.
- Brands are responsible for truthful offers; safe and lawful products, services, and experiences; and fulfilling what they promise.
- Creators and creatives are responsible for accurate profiles, lawful content, required disclosures, and completing accepted work to the agreed scope.
5.Campaigns, briefs, offers, and bids
The platform supports product seeding, service trades, experiences, discounts, gifted campaigns, and paid campaigns, as well as creator- and creative-initiated bids.
- Brands may publish briefs and offers; creators and creatives may apply or submit bids with proposed scope and pricing.
- A brand may approve, decline, or counter a bid. Once a brand approves and authorizes payment, the engagement is locked to the agreed scope and amount.
- Changes to scope, deliverables, timing, or usage after lock-in require mutual agreement and may require updated terms or payment.
- Cancellations and disputes are handled as described in these Terms and the Payment & Access Pass Terms; we may, but are not obligated to, assist in resolving disputes.
6.Prohibited conduct
- Misrepresentation of identity, audience, capabilities, or results.
- Fraud, fake engagement, manipulated metrics, or deceptive practices.
- Offering or promoting unsafe, illegal, counterfeit, or recalled products or services.
- Posting infringing, defamatory, or unlawful content, or content that violates third-party rights.
- Harassment, hate speech, threats, or abusive behavior toward any user or staff.
- Circumventing the platform to avoid fees, including taking introduced relationships off-platform to evade the WITHINFEED Access Pass.
- Scraping, reverse engineering, interfering with, or attempting to gain unauthorized access to the platform.
7.Payments and the WITHINFEED Access Pass
Brand subscriptions, creator and creative bids, brand approvals, upfront payment authorization, the WITHINFEED Access Pass, capture on completion, payouts, cancellations, refunds, and disputes are governed by the Payment & Access Pass Terms, which are incorporated into these Terms by reference.
8.Intellectual property
Platform content
The WITHINFEED platform, including its software, design, trademarks, and content we provide, is owned by WITHINFEED / Second Nature and protected by law. We grant you a limited, revocable, non-exclusive license to use the platform per these Terms.
User content and content rights
You retain ownership of content you create, subject to the licenses and usage terms you agree to. How creator content may be used by brands and by WITHINFEED — including reposting, paid media, whitelisting, portfolio, and editorial use — is described in the Usage & Content Rights policy.
9.Disclaimers
The platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or secure, or that any opportunity will result in any particular outcome.
10.Limitation of liability
To the maximum extent permitted by law, WITHINFEED and Second Nature will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from your use of the platform. Our aggregate liability for any claim will be limited as set out in the final agreement.
11.Indemnification
You agree to indemnify and hold harmless WITHINFEED and Second Nature from claims, damages, and expenses arising out of your content, your use of the platform, your engagements with other users, or your violation of these Terms or applicable law.
12.Termination
You may stop using the platform at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or for operational reasons. Certain provisions survive termination, including those relating to content rights, payments owed, disclaimers, liability, and indemnification.
13.Governing law and disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles, and disputes will be resolved in the state or federal courts located in Florida, unless otherwise agreed in writing.
